Question: I recently married in 2022. When I got married, I went to the SS office and changed my name with them first. My husband is Puerto Rican and has two last names. At the SS office, I took only his first last name. I hyphenated my maiden name with his first last name with no issues.

I then went to the DMV to change my DL. My DMV will not allow me to change my Driver's License to the name on my social security card because my husband technically has 2 lasts names, which are both present on our marriage certificate. They say I must take both of his last names. I do not want to have three last names so have been unable to change my license.

Am I able to get my passport without my DL having my new name? Despite my SS card having my new name?

Answer: Yes, you still can. If you would like to have your hyphenated maiden name on your passport, you need to submit a copy of your SS card and one other secondary ID bearing said hyphenated name.

Question: Hello. My maiden and husband's last name was hyphenated after I got married.(ex: Doreen M. Smith-Scott) However, I was divorced 15 years ago and never went back to my maiden last name afterwards, as it was never requested during the divorce.

However, I was just granted a name change to return to my maiden last name. Currently, my DL is still in both my hyphenated maiden and married name. I had applied for my passport before being granted my name change which, was luckily is in my maiden name only (Doreen M. Smith). I plan to travel to Mexico soon. Will I have a problem leaving the country because I haven't changed my DL and ID card to only my maiden name yet? Does my passport and ID's have to match exactly to travel out of the country? Answer: You may submit a new application in the name that matches your birth certificate. Since your primary ID (license) bears a different name, you must submit a copy of your SS card and one other secondary proof of identity with your application.

Answer: You cannot use your SS card as proof of legal name change. Since you changed your name via marriage, the only acceptable proof of legal name change is your marriage certificate.

Having said that, you do not need to submit proof of legal name change for a new application which you should be submitting. Since your most recently-issued passport expired over 5 years ago, you need to apply as if it's your first passport. The new passport should be issued in your married name since your primary ID (driver's license) also bears that name.

Question: I had gotten my passport before I married. I married overseas, and the marriage certificate for that is in that country's language and in that country. I submitted a copy of that with a passport application so the current passport is correct. I did that overseas.

The problem now is that Social Security is refusing to accept the corrected passport as proof of my NAME and won't change it in their system.
That makes me get a "name mismatch" on everything I apply for. I'm not sure if I'll be able to get a driver's license (I'm back home now) but I was able to get library cards replaced. Oh and what happened to my original marriage certificate, my bag has gotten stolen and my papers stolen so many times while I'm overseas that I've lost count. The only replacement is to send to that country through its Consular Services at its Consulates here, for another "original."

Why is Social Security being so strict about this? When I explained this same thing to the offices in Massachusetts and Connecticut they were willing to work with me, and told me to bring in the passport in person. Out here in California now, whole different ballgame. And they're insisting this is not "document abuse" when it's the very definition of document abuse. I went into the office in person with the passport and the person behind the bulletproof glass said no. And that this wasn't "forcing" me back into my maiden name or being discriminating (they didn't do this to my mother's generation!). So now, what, I sit up and wait four months for a copy of my passport records from the Department of State since the copy of the certificate will be THERE. FOUR MONTHS!?!?

Answer: A passport, aside from being a travel document, attests to your citizenship and identity. It is not, however, proof of legal name change. Government offices will only accept the actual document that you signed to change your name which in your case is your marriage certificate. This is not document abuse, certain documents serve certain purposes only.

Middle name

My divorce decree allowed me to change my last name back to my maiden last name; therefore, my Birth Certificate & SS Card have my maiden last name. Since you cannot submit primary proof of identity (driver's license), you may submit a combination of secondary proof of identity. This can be your Social Security Card and any other ID that shows your current legal name.

Answer: The names on your passport and social security card do not need to match. But if you want to change the name on your passport, you will need a court order as evidence of legal name change.

Another option is to submit at least 3 public records that prove exclusive use of the name for at least 5 years. More often than not, applicants who go this route are asked to submit more documents which delays the process. We recommend that you provide primary evidence of legal name change to avoid issues.

Answer: You need to change the name on your driver's license at the local DMV office. To change the name on your passport, you need to submit the following:

Answer: TSA's Secure Flight Program requires that the names on your airline tickets and passport match. You should have no problems boarding your flight.

Marriage certificate does not match

Answer: If you are applying for a passport for the first time and your identification document has your married name on it, your marriage certificate should not be necessary. However, some agents do request it and, therefore, we recommend that married applicants send them.

Since your marriage certificate does not have your current married name on it, you should not send it unless you were issued a passport in the past. Your application may be processed. If a name change document is requested and it has not been more than five years since the change occurred, you will need to obtain a court ordered name change.

If you were issued a passport in the past, a name change will be required with your application form.

Name change prior to 9/11

Question: Hello. Prior to 9/11 I was able to add my step-father's last name to all documents. I never went to court to officially have it changed. My social security card has both last names (not hyphenated), my license has my step father's last name as my last name and my birth last name as middle name along with my middle name, my taxes have been filed under both last names. My SS card has all four names spelled out and evidently considers the forth name (married name) as my legal last name. Answer: If your birth certificate lists Anna-Belle as your first name and that is how you want it to be listed, then it should not be necessary to obtain a court order. You can apply for a correction to your passport without any additional cost. Mail a completed form DS-5504, passport, birth certificate and a brief letter of explanation to the address on the form. There is no fee unless you request expedited service.
