Travel with my passport in my maiden name and my marriage certificate

Question: My driver's license has my married name but my passport still has my maiden name. If I have a certified copy of my marriage certificate, will I be allowed to travel like this?


Answer: Ideally, your passport would have your current, legal name in it. However, you should not have any problem using a passport with your maiden name and your marriage certificate if you travel by land or sea. Contact the cruise line for verification if you plan to take a cruise.

TSA’s Secure Flight Program requires the name on your ticket match the name in your passport. So, you might have a problem if you plan to travel by air. Contact the airline for their recommendation.

If you need to apply for a name change, there are a couple of ways to do this depending on when your passport was issued.

If it has been one year or less since your passport was issued and you can provide proof of the name change, then you can submit form DS-5504 to the address on the application. There is no fee for this service.

If it has been more than one year since your passport was issued and you can provide proof of the name change, then you must submit form DS-82 to the address on the application along with your most recent passport and one passport photo. The fee is $110.

Regular processing takes 4-6 weeks. You can request expedited service and get the name changed in your passport in just 2-3 weeks. There is a $60 fee for this service.

If you need the name changed in your passport in less than two weeks, you need to visit a regional passport agency or apply through an expedited passport courier service.

I sent a copy of my marriage certificate with my passport renewal, but they are refusing to renew my passport with my married name. (My DL, SS card, and all legal documents are all in my current, legal, post-marriage name). I'm afraid I don't have any proof beyond proof that my legal name is my legal name. How extremely frustrating. What now? Can I have them just renew it in my maiden name? Will I have to resubmit the fee to do that?

Answer: Marriage certificates have different formats and in most cases, it is acceptable as proof of legal name change even without listing the new married name. This is because of the assumption that the woman takes the man's name following said marriage.

Please contact the NPIC at 1-877-487-2778 for a more thorough explanation as to why your marriage certificate was not accepted. Alternatively, you may submit a new application instead of a renewal. New applications do not need name change paperwork as long as you can provide sufficient identification documents bearing your current legal name.

Adding maiden name to passport

Answer: Hi, Valerie. Since this is not an actual name change, the easiest way to go about it is to submit a new passport application. You can then just enter the name you want on Form DS-11 and as long as the name is supported by the ID you present with the application, it should be printed on the passport. It will also help if you include signed request for the said name to be printed and a short explanation as to why.

Married Name on Ticket; Hyphenated Name on Passport

Answer: Yes, you should still be able to fly. Just take proof of link between names on ticket and passport like your birth certificate and marriage certificate.

Answer: You cannot use older one in your maiden name. It was already invalidated when you applied for a renewal with name change after you were married.

If you want to revert back to your maiden name on your passport, you need to submit the most recent one (with your married name) for a renewal. You also need to submit the original divorce decree as evidence of legal name change.

The passport in your married name will be returned to you invalidated but with the stamps intact. You cannot have the stamps transferred to your new passport but you will still have them in the old ones.

Answer: You can apply for a passport in either your maiden name or your married name. You do not need to change the name on your driver's license and/or SS card before applying for a passport in your married name. You do have to submit evidence of the legal name change such as an original or certified copy of the marriage certificate. Note, TSA's Secure Flight Program requires the name in your passport match the name on your airline ticket.

Flying with my maiden name

Answer: Yes, you will be able to fly. You can continue to use your passport with your maiden name in it until it expires. If you do so, you should book airfare in the same name. Unless your passport was issued less than 12 months ago, you will pay the renewal fee of $110 if you choose to change the name in it.
