Question: My driver's license has my married name but my passport still has my maiden name. If I have a certified copy of my marriage certificate, will I be allowed to travel like this?


Answer: Ideally, your passport would have your current, legal name in it. However, you should not have any problem using a passport with your maiden name and your marriage certificate if you travel by land or sea. Contact the cruise line for verification if you plan to take a cruise.

TSA’s Secure Flight Program requires the name on your ticket match the name in your passport. So, you might have a problem if you plan to travel by air. Contact the airline for their recommendation.

If you need to apply for a name change, there are a couple of ways to do this depending on when your passport was issued.

If it has been one year or less since your passport was issued and you can provide proof of the name change, then you can submit form DS-5504 to the address on the application. There is no fee for this service.

If it has been more than one year since your passport was issued and you can provide proof of the name change, then you must submit form DS-82 to the address on the application along with your most recent passport and one passport photo. The fee is $110.

Regular processing takes 4-6 weeks. You can request expedited service and get the name changed in your passport in just 2-3 weeks. There is a $60 fee for this service.

If you need the name changed in your passport in less than two weeks, you need to visit a regional passport agency or apply through an expedited passport courier service.

I have changed my passport already to my married name but my visa (already expired tho) is in my old passport which is not active anymore. We already bought plane tickets for September, but I'm concerned if I will have any issues that there is no stamp in my new passport when I first came in to Kyrgyzstan and also left from US under maiden name and now coming back home under married name.

Please tell me if I'm in a serious trouble or I'm safe to go back home and I wont be stopped at the border control?

Answer: As long as you arrive in the United States with a valid passport, it will not matter that you left the country on a different name.

You need to contact the immigration office of Kyrgyzstan about your status -- the expired visa may be an issue if you overstayed. The lack of stamp on your new U.S. passport will not be an issue if you can present the old passport and pertinent documents to explain the difference in last names between the two.

Answer: You cannot use older one in your maiden name. It was already invalidated when you applied for a renewal with name change after you were married.

If you want to revert back to your maiden name on your passport, you need to submit the most recent one (with your married name) for a renewal. You also need to submit the original divorce decree as evidence of legal name change.

The passport in your married name will be returned to you invalidated but with the stamps intact. You cannot have the stamps transferred to your new passport but you will still have them in the old ones.

Answer: Changing your name does not invalidate your passport. You should be able to use your passport for travel to Guatemala and return to the United States without a problem.
