Does a 17 year old need both parents' consent to be issued a passport?

Question: My 17-year-old has not seen his biological father in 14 years.

Answer: While the U.S. Department of State requires applicants ages 16 and 17 to establish parental consent, their website states, "You may be requested to provide written parental consent for a child age 16 or 17 if it is not implied on the application." However, it does not state how one might imply consent on the application form. We have been told that consent is implied if the minor pays the fees with a parent's check. There is inconsistency with how such cases are treated. In most cases, a 17-year-old can apply without the presence of a parent.

My dad has my passport

Question: My parents are divorced and I live with my mom. My dad just applied for a passport for me and he is insisting he keep it but I’m 17 and I want my mom to have it until I turn 18. Does he have to give it to me or is he allowed to keep it?

Answer: Your father can keep it. But since you are already 17, the Department of State allows you to apply for your own passport and have your mother provide the statement of awareness of the application. Once you submit the application, the passport in your father's possession will be invalidated.

Not clear Instructions

Question: It should be made more clear for those applying for a renewal passport for minors and also if the child is age 17 if the form 3053 is required. I lost my scheduled appointment because of no clear or specific instructions on having a DS-3053. The post office says one thing and the internet says something different. Furthermore, I waited one month for an appointment to go for the renewal of my passport.

Answer: Hi, Michael. Form DS-3053 is not required for applicants aged 16 and 17 provided that they can present their own government-issued ID.

Question: I’ve learned that I’m a US citizen from my father. He became a citizen when I was under the age of 18. I’m over 18 and I applied for a US passport. Weeks after the application, I was mailed that they need custody papers but I’m already over the age what do I do?

Answer: The custody papers they are referring to should date back to when you were underage. Custody under the U.S. citizen parent must be established in order to transmit citizenship.

Please contact the USCIS for more information regarding citizenship.

Question: I am 17 yrs old, my mother got married to my American stepdad when I was 6 yrs old. He passed on in 2021. My mother is applying for a widow visa. My brothers have American passports. Can I also get an American passport? Can I also join them in traveling to the USA?

Answer: Only U.S. citizens may apply for an American passport. If you were legally adopted by your stepdad, there is a chance that you will be given citizenship when you are admitted to the United States.

If this is not the case, you may still travel to the United States with a foreign passport and the appropriate visa.

We recommend that you contact the closest U.S. Embassy or Consulate for further assistance regarding citizenship and possible travel to the United States.

Question: My mother just got back from abroad to fix and help me renew my passport. As said years ago when we tried to renew my passport, at the age of 17 it is okay if only one parent accompanies me.

I am 17 now and we plan on fixing it now. But her leave for work is only a month and I was not able to schedule an appointment within the month. My father accompanying me is not an option as he passed away recently. What should I do to be able to renew my passport?

Answer: Your mother does not have to be present when you submit your new passport application. Consent/awareness may be shown through a signed statement (no need to notarize) or implied by her writing a check for your passport fees. We recommend both.

Question: Hi. I helped my brother-in-law apply for a passport, he’s 17 years old and he had his own identification.

However, his brother and I are not his legal guardians. He’s living with us and his Dad's in jail and his Mom is in Mexico. Is it possible for him to be able to get his passport without any parental consent? This was almost 6 weeks ago when we sent out the application at the post office and we haven’t received a letter from the Passport agency saying they need parental consent or any other information?

Answer: Have you checked the application status online?

Check the Status

If it is already "in process" then the documents you submitted were likely sufficient. Parental consent is not a requirement. The applicant must only establish parental awareness of the application being submitted. This may be shown by a check for the fees written by a parent or a signed letter stating awareness.

You may contact passport services at 1-877-487-2778 for more information.

Question: Dad was deported to Mexico when I was 2 and my mom just passed in May of 2020. I currently live with my aunt and uncle and want to go on vacation with them. Can they sign for my passport?

Answer: We're sorry to learn about your loss.

At 17, you may apply for your passport without a parent present if you already have your own government-issued ID. What you will need implied consent from your custodians. This can be in the form of a signed consent (no need to notarize) or they may simply write a check to pay for the passport fees.

Question: My son is 16 years old and I have custody and his mom lives in Dubai. She wants him to travel but he does not have a passport or ID. I don't want him to travel. Can he get a passport without my permission? I have custody and he lives with me.

Answer: It's a tricky situation because of the minor's age. As a general rule, 16 and 17-year-old minors may apply with only one parent's consent. However, the said minor must also present a valid government-issued ID. Since your son does not have an ID, he needs a parent to present identification on his behalf. Since the other parent is overseas, she cannot help your son apply.

So in a nutshell, your son cannot apply for his own passport without you or the other parent's presence and ID. You may contact passport services at 1-877-487-2778 for more information.
